Terms of Service

1. Who you're contracting with
Buildersworkshop (the "Service") is operated by Buildersworkshop ("Buildersworkshop", "we", "us"). By creating an account or using the Service, you agree to these Terms of Service.
2. Your account
You must be of legal age and, if signing up on behalf of a company, have authority to bind that company. You are responsible for the accuracy of the information you provide, keeping your credentials confidential, and all activity that occurs under your account.
3. What the Service does
Buildersworkshop helps contractors estimate jobs, manage photos and plans, track wholesalers, generate quotes and invoices, and track payments. Features may change or evolve over time.
4. Licence
We grant you a limited, non-exclusive, non-transferable right to access and use the Service in accordance with your subscription plan and these Terms.
5. Acceptable use
You must not misuse the Service. In particular, you agree not to:
- Use it for anything unlawful, fraudulent, or deceptive;
- Send spam, malware, or infringe anyone's intellectual property;
- Attempt to probe, scan, scrape, or interfere with the security or integrity of the Service;
- Reverse engineer, resell, or circumvent technical limits of the Service.
6. Your content
You retain ownership of the content you upload (photos, plans, notes, client info, invoices). You grant Buildersworkshop a limited licence to host and process that content solely to provide the Service to you.
7. Our intellectual property
The Service, including its software, design, branding, and documentation, is owned by Buildersworkshop and its licensors. Nothing in these Terms transfers ownership to you.
8. Payments, subscriptions, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Subscription pricing, billing cycles, taxes, cancellations, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.
9. AI-generated estimates
Buildersworkshop uses AI to suggest labor hours and materials from the photos, plans, and descriptions you provide. These suggestions may be inaccurate or incomplete and are not a substitute for a licensed contractor's professional judgment. You are responsible for reviewing and adjusting any AI output before sending a quote or invoice to a client. You confirm you have the rights to any content you upload.
10. Service level
We work hard to keep the Service running, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is capped at the fees you paid us in the 12 months before the claim. We are not liable for indirect, incidental, consequential, or special damages (including loss of profits, data, or goodwill). Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, where such limitation is not permitted by law.
12. Indemnity
You agree to indemnify Buildersworkshop against claims arising from your content, your use of the Service, or your breach of these Terms.
13. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly or seriously violate our policies. You may cancel at any time via your billing settings (see the Refund Policy). On termination, you can export your data for a reasonable period before it is deleted.
14. Changes
We may update these Terms from time to time. Continued use of the Service after the changes take effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the jurisdiction in which Buildersworkshop is established, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory local law provides otherwise.
16. Assignment and force majeure
You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delay or failure caused by events beyond its reasonable control.
